HEALTH OVERHAUL-KENTUCKY

No new technical problems for health exchange site

FRANKFORT, Ky. (AP) — Officials say the website that holds Kentucky's online health insurance exchange appears to have become smoother for users on its second day of operation.

Kynect had nearly 110,000 visitors through late Wednesday afternoon, with about 10 percent of them starting applications for health care coverage. Nearly 7,000 applications have been completed.

Gov. Steve Beshear's office says the site, http://kynect.ky.gov, had no interruptions in service on Wednesday. Technical glitches on Tuesday interrupted online applications for several hours on the first day of the six-month open-enrollment period under the new health care law.

Technical problems were also reported in other states, and some continued into Wednesday.

RICHMOND, Ky. (AP) — An Indiana doctor allegedly caught on video pointing a gun at a motorist and firing is facing a wanton endangerment charge in Kentucky.

Dr. Perrin Dobyns pleaded not guilty Wednesday during an appearance in Madison County District Court.

WKYT-TV in Lexington reports Dobyns was arrested at his office at the Branchville Correctional Facility in southwestern Indiana on Monday, the day after the incident on Interstate 75. The station reports Dobyns was the prison's physician.

The incident was captured on video by David Kollar. Kollar says he noticed a motorist driving erratically and pulled out his phone camera. The video shows a man in a black car pointing a gun in Kollar's direction.

Kollar was not hurt. He called police and sent them the video when he returned home.

LRC DIRECTOR

Ky. lawmakers take step toward review of LRC

FRANKFORT, Ky. (AP) — Top Kentucky lawmakers have appointed an acting director for the Legislative Research Commission and took the first step toward reviewing the fact-finding and service agency for legislators.

The action comes amid scrutiny of how the LRC handled sexual harassment complaints against a former lawmaker.

House and Senate leaders meeting Wednesday appointed Marcia Seiler as acting LRC director. Seiler is director of the Office of Education Accountability.

Bobby Sherman recently resigned as LRC director. State police are investigating whether any laws were broken when Sherman returned to his office and shredded documents after his resignation. Two legislative workers have filed a lawsuit accusing former state Rep. John Arnold of sexual harassment.

The lawmakers also agreed to approach the National Conference of State Legislatures about conducting a performance audit of the LRC.

DERBY PIE DISPUTE

Derby Pie maker, restaurant end trademark dispute

LOUISVILLE, Ky. (AP) — A chocolate-nut pie by any other name may be just as sweet, but it won't be a Derby Pie.

Kern's Kitchen, the Louisville-based company that makes the famous dessert, and Claudia Sanders Dinner House settled a dispute over the trademark on the name Derby Pie. Under the agreement approved by U.S. District Judge Gregory Van Tatenhove, Claudia Sanders Dinner House in Shelbyville and its employees are permanently barred from using the Derby Pie name to promote the chocolate pie made with pecans and chocolate chips.

Kern's Kitchen holds a trademark in the name of the sweet treat, which was created in 1950 at the Melrose Inn in Prospect.

Kern's Kitchen sued Claudia Sanders Dinner House in June, alleging the company violated its trademark by using the name.
